(受聘方)簡稱乙方：

甲方因生產(chǎn)(工作)需要，按照有關規(guī)定，已報請主管部門的批準，甲方向乙方如實介紹合同的有關情況，經(jīng)雙方協(xié)商同意自愿訂立本合同，并共同遵守如下條款。

一、合同期限

自______年____ __月_______日起至_______年______月______日止。合同期滿，本合同自行終止。如甲方需要繼續(xù)留用，經(jīng)乙方同意，雙方可以續(xù)訂合同，并辦理鑒證手續(xù)。

二、生產(chǎn)(工作)任務

甲方聘任乙方擔任_______________職務。

三、勞動報酬

(一)勞動報酬：按國家有關規(guī)定和單位的實際情況，根據(jù)乙方的崗位和承擔任務，甲乙雙方協(xié)商定為每月_________元。

(二)勞動保護、保險福利待遇

甲方負責給乙方上意外保險二份，乙方自上一份，若出現(xiàn)意外傷殘、死亡等情況，由保險公司按照保險條例負責賠償。福利按照企業(yè)業(yè)績情況適當給予。

四.勞動紀律

按時上下班，不得遲到早退。嚴格遵守操作規(guī)程，保證生產(chǎn)。愛護單位財產(chǎn)，不無故損壞公物。聽從指揮，服從調(diào)動。保質(zhì)保量完成任務，不得投機取巧。有事及時請示報告，不得擅自主張。

五.有下列情形之一的，本合同自行解除：

(1)甲方宣告破產(chǎn)，或者瀕臨破產(chǎn)處于法定整頓期間的。

(2)乙方被除名開除、勞動教養(yǎng)或判處徒刑的。

六.乙方在合同期內(nèi)有下列情形之一的，甲方可以辭退;

(1)嚴重違犯勞動紀律，影響生產(chǎn)、工作秩序的;(2)違反操作規(guī)程，損壞設備、工具，浪費原材料、能源，造成經(jīng)濟損失的;(3)服務態(tài)度惡劣，損害消費者利益的;(4)有貪污、盜竊、賭博，營私舞弊等違法行為，尚未構成刑事責任的;(5)無理取鬧、打架斗毆，嚴重影響社會秩序或犯有其他嚴重錯誤的。

七、違約責任

乙方違反本合同有關條款給甲方造成經(jīng)濟損失的，甲方可根據(jù)實際損失情況要求乙方予以賠償。乙方不經(jīng)甲方同意私自離單位的，賠償甲方 元。 本合同于 年 月 日起生效，。甲乙雙方不得擅自修改或解除合同。本合同一式兩份，甲乙雙方各執(zhí)一份。
